(Texas) Anti-Breeder Bill HB 1451. This bill is not written to regulate dog and cat breeders but to eliminate them. The requirement of minimum standards equal to federal (USDA) regulations means home based breeding in Texas will become illegal.

The exemptions for certain working dogs are not defined and qualifications
will be written by an Advisory Committee. It is impossible to find an
impartial advisory committee in this state as the extremists have
infiltrated all levels of government, State Bar Animal Law Section, humane
societies, animal controls, etc. Remember the THLN mole, Della Lindquist,
in Texas Dept. of Licensing & Regulation that helped write the bill? Animal
Rights Extremists are opposed to all working dogs and pet ownership in
general.

Please renew all efforts. If the bill becomes law without Governor Perry's
signature, he still "owns" it. This will harm his future political
aspirations as he's contemplating running for president. Tell him all eyes
are on Texas! Veto HB 1451! Save Our Pets!

All, Please call your state senator ASAP.... This one's a biggie! 

My (Kathy Heaton's) senator is Whitmire - the bill's sponsor.  The person I spoke with in his Austin office said there was a lot of confusion about the bill. I agreed and advised her that much of the confusion exists because its author (Thompson) and sponsor (Whitmire) don't fully understand the potential implications. I mentioned that I hoped my grandchildren would not know dogs and cats only as another endangered species at the zoo, and that I *had* previously supported and campaigned for Whitmire when he ran for election.

She indicated the final version of the bill is not online and that it has a life expectancy of about another two weeks?  (May it die a quick and painless death...)

HB 1451 as it has been amended is now online.  It has been posted on the intent calendar, which means it can be voted on tomorrow.  Dan Patrick's office told me that the requirement that 48 hours has to elapse before the bill can be considered has been suspended because it's so close to the end of term. 

The bill will still apply to anyone who has 11 intact females over 6 mo. old, but dogs bred for hunting or retrieving or for agricultural use will be
exempted. the 25% ownership has been changed to apply to someone owing the facility rather than ownership in a dog. 

Inspections will still be made without notice wherever the dogs are kept as well as wherever the records are kept, which means that they can enter your home if  you raise your puppies in the house and/or have your records on a computer there. 

It's purported to be self-financing and donations can still be taken and the funds used to pay informants.  

It's very important for people to call their Senators and tell them that you oppose this bill and want them to do the same.  It' is especially important for people outside of Houston to register their opposition and it needs to be done in the morning.  You can find your Senator's name and phone number in Austin at
http://www.legis.state.tx.us. 

Even if you don't breed dogs, if you want to ever own a purebred one and don't want to go out of state to buy it, you need to oppose this bill. 

For those of you who think this doesn't apply to you because the agriculture and sporting lobby managed to get you exempted---you may draw a bye this time, but before the next session, you'll be a target. There'll be a raid on a kennel that makes the news and you'll be on the hit list again.

If 11 intact females seems like a terribly large number to you, you should realize that show people might have that many but never breed more than one or two a year.  They might easily have a few young females that they're growing out or showing with the intent of placing them later.  This isn't going to accomplish what it purports it is going to do, no matter how well-meaning the people who support it are.  It's designed to shut down breeding of dogs and cats and to be ratcheted downward as time goes on - until almost no one is left.

Keep up the good work!  The key is quantity of phone calls and emails.  Please make the phone calls!  If you have time, Call Senator Dan Patrick [at (512 463-0107 or in Houston at (713) 464-0282  or by FAX at (281) 9336-0274] and thank him for supporting dog and cat breeders and ask him to help us defeat this legislation in the Senate!  Call as many of them as you can if you live in Texas.

The Fish and Game Dept was there - they had one statement and there was some discussion with him. They wanted to have an amendment so that this would be changed to a rule, or something like that, that disallows the release of these birds. This allows them to sort of save face and not get embarrassed, but we don't care because we can still own, sell, breed, etc. It seemed at first like we had been screwed but I think it is really a win for all.

Jeanine spoke first and she nailed it. The Senators said that was the best opening argument they had ever heard!!! Then Rep Birdsell (that's right, Birdsell) spoke and did great. Then Spec Bowers made some great points. Then I got up and did a short thing; our lobbyist was there to grease the palms of the Senators; he introduced me to some of them right before the hearing. The guy from F & G was respectful - he said after the hearing that they know that they have to be a little extreme sometimes, but they did express good intentions and willingness to work with people better where these issues are concerned. Brenda Piper did a great job; Allen made a bunch of great points. Norman Brandt spoke
and was great. Jan was awesome too, really. Everyone did their part and we kicked ass.
